Welcome to Lest ("Company", "we", "our", "us"). These Terms of Service ("Terms", "Terms of Service") govern your use of our website located at www.lest.com and our shipping services (together or individually "Service") operated by Lest.

Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). You acknowledge that you have read and understood Agreements, and agree to be bound by them.

3. Shipping Services

Lest provides Less than Container Load (LCL) shipping services across China and ASEAN countries. By using our shipping services, you agree to the following terms:

• You will provide accurate and complete information about your cargo.
• You will comply with all applicable laws and regulations regarding the shipment of goods.
• You will not ship prohibited or dangerous items without proper declaration and approval.
• You will pay all fees associated with your shipment as agreed upon at the time of booking.
• You understand that shipping times are estimates and may be affected by various factors beyond our control.

4. Bookings and Payments

When you book a shipment through our Service, you agree to provide current, complete, and accurate information for all bookings made on our platform. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password.

Payment for our shipping services is due at the time of booking unless you have established credit terms with us. We accept various payment methods as specified on our website. All payments are non-refundable except as expressly provided in these Terms or as required by applicable law.

5. Cancellations and Modifications

You may cancel or modify your booking subject to the following conditions:

• Cancellations made more than 72 hours before the scheduled departure may be eligible for a full refund.
• Cancellations made between 72 and 48 hours before the scheduled departure may be subject to a 50% cancellation fee.
• Cancellations made less than 48 hours before the scheduled departure are not eligible for a refund.
• Modifications to bookings may be made up to 48 hours before the scheduled departure, subject to availability and potential price adjustments.

6. Liability

Our liability for loss or damage to your cargo is limited as follows:

• For uninsured shipments, our liability is limited to $2.00 per kilogram of the affected cargo, not to exceed $1,000 per shipment.
• For insured shipments, our liability is limited to the declared value of the cargo as specified in the insurance policy.
• We are not liable for any indirect, consequential, or special damages arising from the use of our services.
• We are not liable for delays caused by factors beyond our control, including but not limited to weather conditions, customs delays, or port congestion.

7. Insurance

We offer cargo insurance options to protect your shipments. Insurance coverage is subject to the terms and conditions of the insurance policy. You are responsible for reviewing the insurance terms and ensuring that your cargo is adequately protected. Claims for insured shipments must be filed within the timeframe specified in the insurance policy.

8. Prohibited Items

The following items are prohibited from shipment through our Service:

• Illegal substances and items
• Hazardous materials without proper declaration and packaging
• Perishable goods without appropriate arrangements
• Live animals
• Firearms, weapons, and explosives
• Counterfeit goods
• Any items prohibited by applicable laws or regulations

9. Intellectual Property

Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Lest and its licensors. Service is protected by copyright, trademark, and other laws of both the China and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Lest.

10. Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Lest.

Lest has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Lest shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

11. Termination

We may terminate or suspend your account and bar access to Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms.

If you wish to terminate your account, you may simply discontinue using Service.

All provisions of Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of China, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.

We reserve the right to withdraw or amend our Service, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period.
